The parents of a New Hampshire teen who was killed in an SUV rollover accident have filed a product liability lawsuit against the vehicle's manufacturer.
According to Salem Superior Court documents, 17 year-old Jason Alan Foster was one of two people riding in the back seat of a 2000 Mitsubishi Montero on the morning of August 6. 2009, when the driver lost control and rolled over on a curve. Foster was thrown from the vehicle and killed.
Foster's parents, Charles and Michelle Foster, filed a lawsuit earlier this month against Mitsubishi Motors North America alleging that the design of the Montero is "unreasonably dangerous" and is to blame for their son's death. The Fosters' attorney, Joseph Balliro Jr., says the Montero is "notorious" for rollover crashes.
A number of lawsuits have been filed nationwide alleging that the Mitsubishi SUV is top-heavy and likely to roll. Juries have awarded judgments of more than $11 million in other lawsuits.
