Merck & Co. attempted to exclude testimony from 24 personal injury cases, but its attempt was rejected by a federal judge Wednesday. In the case, the company wanted to reject testimony that Fosamax could cause a severe jaw condition known as osteonecrosis.
The 24 personal injury cases represent the first of many product liability cases expected to be brought against the drugmaker. Lawyers for the prosecution are arguing that the company failed to notify doctors of the possible side effects of the drug.
