$100,000 Settlement in Inmate’s Lawsuit

Corrections Department officials agreed to pay $100,000 as part of a settlement deal in a lawsuit filed by a former inmate whose back was broken in a confrontation with a corrections officer in 2003.

Gerrese Daniels was determined to be faking his injuries by two jail nurses after corrections officer Matthew O’Kon allegedly slammed him into a wall. However, after being transported to the Central Florida Reception center and subsequently airlifted to an Orlando hospital, it was discovered that his 4th and 5th vertebrae had been severed.

Prison Health Services, the company hired to provide medical care to inmates, is still in the lawsuit. The sheriff’s department did not renew the company’s contract last year.

$80k Settlement In Police Dog Bite Case

The parents of Tyler Cox reached an $82,500 settlement with Washington County in a lawsuit over injuries caused to their son by a police dog in November 2004. The parents’ suit claimed that the police dog was improperly left unattended in the garage of their home in Beaverton while Tyler, his younger brother, and older sister were in the house. After one of the children let the dog into the house, Tyler was bitten, causing wounds which required 187 stitches to close.

Tyler’s parents originally sought $250,000 in their lawsuit due to the future cost of counseling and medical care for their son.

Dangerous Peanut Butter leads to lawsuit

Peter Pan peanut butter was recalled from store shelves after a batch of defective peanut butter has caused several consumers to become violently ill. Helen Williams felt the full and unpleasant effects of the peanut butter. She filed a personal injury lawsuit against the makers of Peter Pan peanut butter after discovering that her peanut butter contained salmonella.

The CDC published an article stating that 628 people in 47 states have been effected by the defective peanut butter. The makers, ConAgra, have stated that they attribute the salmonella to moisture in their plant that caused bacteria to grow.

Williams notes that ConAgra failed to properly inspect their product before selling it to consumers and is reponsible for her illness. She is seeking damages for medical expenses, increased anxiety, and lost wages.

Bravada’s faulty restraint system leads to defective auto lawsuit

Barbara Owens was involved in a car accident when she was released from her seat and ejected from her vehicle. She has filed a lawsuit against General Motors and Jack Schmitt Oldsmobile-Cadillac. After being thrown from her Oldsmobile during the crash, Owens suffered a great deal of pain, as well as permanent damage to her back, neck, head and body.

Owens claims that she was never informed of Bravada’s dangerous defects. Her seatbelt was defective and released her from the seat in the middle of a rollover situation. She blames GM for the fautly design and the auto dealer for selling her a dangerous vehicle.

Owens is seeking $200,000 in damages for medical expenses, lost earning capacity, disfigurement, pain and suffering, and mental anguish.
