Defective seat belt prompts lawsuit

Sarah Smith bought a used 2001 Ford Escort ZX2 at Bert Wolfe Ford in Charleston, NC. She has filed a lawsuit against Ford Motor Company over a defective seatbelt that caused her injuries.
She was driving with her son when a deer crossed in front of her car. She struck the deer and her vehicle came to a sudden stop. The seatbelt did not properly restrain her and she was thrown forward. The airbags also did not deploy. Smith sustained severe injuries to her back when she was thrown around her car and into the steering wheel as a result of her faulty seatbelt.
Smith states that she was never made aware of the defect before the accident. She states that the seatbelt was factory issued and should have been properly tested for defects before it was released into the market. Smith suffered injuries to her back, abdomen, and chest during the accident.
She is seeking damages for medical expenses, loss of income, pain, mental anguish, and disability. She also seeks compensatory and punitive damages.

Manufacturer and store sued over a defective model airplane injury

A hobby store and manufacturer are being sued after a man is injured while constructing a model airplane. Paul Moore was constructing a Great Planes model airplane, purchased at Tower Hobbies, when the spinner wire broke loose and pierced his abdomen. This in-turn punctured his gall bladder.
Moore was immediately taken to Cabell Huntington Hospital and was rushed into emergency exploratory and reconstructive surgery. The doctors preformed the surgery to remove the 1 inch piece that was stuck in his abdomen. Two weeks after the initial surgery, he had to return to the hospital to have his intestines re-inserted into his abdomen.
Moore claims the defective design and inadequate warnings of danger led to his injuries. He is suing the manufacturer and the hobby store where the plane was purchased. Moore is seeking damages of $75,000 which includes medical expenses, physical pain, and mental anguish.

Apartment complex is blamed for injury on storm drain

Ernestine Ruth Plante filed a personal injury suit against the companies that own her apartment complex after she was injured. Ruth claims that the companies that defendants failed to maintain the grate cover of a storm drain at the end of her driveway. According to the suit, the grate cover was broken and a section of the drain was exposed.
While waiting for the bus, Ruth stepped backwards and her foot landed in the open portion of the drain. This caused her to fall, fracture her leg, and hit her head on the pavement. She claims that the companies were negligent in maintaining the driveway and she seeks compenstation for all of her injuries.

GM sued in defective safety belt suit

Carolyn Parrack has filed a lawsuit on behalf of Miranda Nicole Parrack, who was killed in a car accident after her safety belt failed. General Motors Corporation and Tygart Valley Motor Company have been named as defendants. According to the suit, Miranda Parrack was a passenger in the 1998 Chevy Blazer when the car was struck and began to roll over.
The safety belts failed to restrain her during the accident and she was thrown from the vehicle and killed. The suit states that the negligence of manufacturer and the distributor of the car are to blame for Nicole Parrack’s death. Carolyn Parrack is seeking punitive and compensatory damages on behalf of Miranda Parrack.
Toy manufacturer brought to court in wrongful death suit

Stephen Tetlow has filed a lawsuit against Hasbro, Inc., after his infant son choked on a toy and died. The toy was a PlaySkool Cool Crew Team Talkin Tool Bench which includes a toy hammer, saw, drill, screwdriver, plastic nails and screws, and a vice.
According to Tetlow, his son was choked by one of the detachable nails that was a part of the playset. The child was taken to a hospital but died before the nail could be removed from his air passage. Tetlow states that the product was defective and dangerous. He also states that Hasbro was negligent in providing sufficient warnings about the possible dangers of the toy.
The tetlows are suing for medical expenses, funeral expenses, punitive damages, and emotional distress.
Medical Malpractice leads to wrongful death suit

Dr. Jack M Levine is facing two malpractice suits in two different states. The latest suit originates from Illinois, where Dr. Levine has been named a defendant in a wrongful death suit. He is one of four defendants.
Peggy Shasteen is seeking damages on behalf of her late mother. She claims That Dr. Levine was negligent in the treatment of her mother and this negligence was the cause of her mother’s eventual death. Mrs. Shasteen’s mother died shortly following a colonoscopy, which was meant to be a gall bladder surgery instead. This mistake caused major complications in Shasteen’s mother’s health. Another issue that is being investigated is the improper preparation of a prep bowl used during surgery. Apparently, the prep bowl was not correctly cleaned.
Overall, Shasteen is suing four different doctors for $300,000. She is seeking damages for her mother’s medical expenses, pain and suffering, and mental anguish.
Malpractice Lawsuit in PA

Dr. Nabil Ghabrial, a Port Arthur doctor, is being sued in a malpractice case involving a surgery gone wrong. While performing surgery on a young girl, her throat burst into flames in a very strange turn of events.
Dale and Miranda Granger took their 6 year old in daughter in for throat surgery and are suing the doctor for negligence. The girl’s surgery was for a routine tonsillectomy, andenoidectomy, direct laryngoscopy and rigid bronchoscopy. During the surgery the girl’s throat burst into flames after a medical machine pierced a plastic tube which ignited due to the oxygen that was leaking from the tube.
The girl escaped with only minor injuries and further surgery was not needed. The girl’s parents are suing for medical expenses, pain, lost earning capacity, and mental anguish.
According to the girl’s father, Dale Granger, his daughter has become much more self conscious now that her voice has become raspy and that she has to drink fluids while eating meals. She gets teased much more at her school for her condition caused by Dr. Ghabrial.

Auto Defects Suit: Ford not built so tough after all

When Jeffery Roebuck bought his new F250 Ford Truck, he was curious about installing a Hypertech power programmer III. He didn’t ask the dealer about adding the programmer III though, he went directly to the parts seller. Not long after the engine blew a gasket and Robebuck quickly learned that after-market parts void the warranty on his new truck.
Roebuck, however, is a lawyer and has a good understanding of the American civil justice system. He is suing Ford, claiming that their motto, “Ford Built Tough” is a fraudulent statement. Roebuck is using for economic damages, mental anguish, and attorney’s fees.
According to Hypertech’s website, the power programmer should not have harmed the cars engine. Roebuck claims that Ford has manufactured and sold trucks with defects and reliability problems. He accuses Ford of knowing of the reliability problems, but selling him the truck anyway under the motto “Ford Built Tough”.

Walmart Personal Injury Lawsuit in PA

Charlotte Green was checking out at the Port Arthur Wal-Mart when she slipped and fell in a puddle of water. According to her petition, she was shopping at the Wal-Mart when she slipped on a puddle of water as she stepped up to an open cashier.
The personal injury lawsuit claims that Wal-Mart should be found negligent for failing to clean up the puddle before it caused anyone injury. Wal-Mart failed to take action to ensure the safety of the customers. The suit did not state the details of Green’s injury.
Green is seeking damages for physical pain, mental anguish, impairment, and past and future medical expenses.

Hospital allegedy responsible for boy’s overdose

A 10 year old biopolar patient at Memorial Hermann Bapist Behavorial Health Center slipped into coma after her began slurring his words and vomiting. After he was taken to a Houston hospital, it became clear that the boy’s condition was the result of lithium toxicity. The boy was diagnosed with ventricular tachycardia.
The boy’s gardian, a grandparent, is suing Memorial Hermann and claims they were clueless that they were administering a dangerous amount of lithium to her grandson. The boy had been hospitalized for bipolar disorder and ADHD and the nurse failed to record the proper amount of lithium carbonate that the boy was taking as medication. She recorded that he was taking 600 mg twice a day, which is twice the recommended dosage.
No one checked the nurse’s paper work and the boy was given the excessive lithium for 6 days until he collapsed.
The boy’s grandmother is suing for his medical expenses, mental anguish, physical pain, and loss of the enjoyment of life for her grandson.
