Halloween Sobriety Checkpoint Yields 13 Arrests

In Tucson Arizona this past weekend, local police set up sobriety checkpoints that resulted in 13 DUI arrests. This was the first sobriety checkpoint set up in 12 years by the Tucson police. A total of 22 officers participated in the checkpoint set up downtown between 6th and 4th streets and Euclid. The area is considered an area with a high volume of DUI arrests and alcohol-related crashes.

According to police records, officers made contact with 881 vehicles and 56 drivers. Of those 56, 13 were considering to be driving under the influence. Also, 2 underage drinking citations were handed out.

Accident Involving Pedestrian Shuts Down Interstate

Near Louisville Kentucky today, a pedestrian that tried to cross an interstate while on a cell phone was struck by a vehicle. It appears that the pedestrian was calling 911 to secure assistance for an accident involving an El Camino and a semi. Generally, pedestrian accidents do not involve such noble intentions as calling 911 for a vehicle accident.

It is recommended by police in the area that if your car breaks down and you must get out of the car, do not turn your back to on-coming traffic. If you must cross the road, never assume that cars will stop and, if it’s dark, do not assume that they can see you.

Two People Killed in Car Crash in Jefferson County

One second is all it takes for tragic consequences to unfold when a person is driving an automobile.  That appeared to be the tragic case recently when two people were killed in an auto accident in a rural area of Wisconsin.  The story was reported in the Milwaukee Journal-Sentinel, and the relevant passage appears below.

“Two people were killed and several people were injured in a two-car collision Sunday afternoon in Jefferson County.

A car carrying three Jefferson-area residents was traveling north on state Highway 26 at Jefferson Road around 2:45 p.m. Sunday when the driver lost control and slid into the southbound lane, striking a pickup truck carrying two people, the Jefferson County Sheriff’s Department reported.”

Four Teens Injured in Rollover Accident

Rollovers are happening with alarming frequency, and the reason for rollovers can be many, but several lawsuits are filed because the vehicles in question do not handle turns as well as one would expect.  That may or may not be the case with a recent accident in the Town of Emmett, where four teens were injured.  The story was reported by the Fon du Lac Reporter.

“Four teenagers were injured in a one-car rollover accident that occurred about 2 p.m. Saturday on County Trunk M just north of Watertown in the town of Emmett.

One of the injured was flown by helicopter to Froedtert Memorial Lutheran Hospital in Milwaukee, and the other three were transported to Watertown Memorial Hospital, according to the Dodge County Sheriff’s Department.

The Wisconsin State Patrol was the first to respond to the scene and was assisted by the Watertown Fire Department and EMS crew, Town of Lebanon EMS and the Dodge County Sheriff’s Department.”

Multi-Million-Dollar Auto Crash Verdict Decision Upheld

In a case that contained both tragedy and an interesting legal issue, the Wisconsin Supreme Court has upheld a lower court’s decision that the Archdiocese of Milwaukee must pay almost $23 million in a judgment to a man who was severely injured in a crash several years ago.  The story was reported by the Milwaukee Journal-Sentinel.

“On March 25, 2002, Hjalmer Heikkinen’s car was struck by a car driven by Margaret Morse, a member of Christ King Parish in Wauwatosa. She was transporting a statue of the Virgin Mary to a family in a different parish as part of a program conducted by the Christ King Legion of Mary, the parish’s branch of a service organization.

Morse went through a red light and struck the car Heikkinen was driving. Heikkinen, then a semiretired barber living in Milwaukee, suffered severe injuries that left him a quadriplegic. Later, one of his legs was amputated. He is unable to feed or otherwise care for himself. He is now 84 and living in West Allis.

Heikkinen sued Morse and her insurance company, the United Services Automobile Association.

Morse, in turn, brought a third-party complaint against the Archdiocese of Milwaukee and its insurer, which provided coverage for the archdiocese and the parish.

The key question before the court was whether Morse was covered by Catholic Mutual.”

Milwaukee Woman Killed in Car Accident

No matter how careful you are in traffic or on public streets, you can never be sure that your safety is guaranteed. Tragically, that point was reinforced recently when a 72-year-old Milwaukee woman was killed as she stepped into a street between parked cars. The story was reported by WKBT in La Crosse.

“Milwaukee police say a 72-year-old woman was hit and killed by a car this morning when she stepped out between two parked cars into the street.

Police say the Milawuakee auto accident happened at 9:45 a.m. and the woman lived nearby. Her name has not yet been released.

They say the driver of the car, a 71-year-old man, was not cited.”

Even though the driver was not cited by police, that doesn’t mean that he is impervious to civil liability if he was negligent. Young Bicyclists Hurt in Traffic Accident

Today in Westland, Michigan, two students remain hospitalized after they were struck by a car as they crossed a road on their bikes during rush hour last night. The students were crossing the road on their bikes when the driver of a red Pontiac Grand AM hit them after she ran a red light. The driver “failed to stop for the red light” and “never even saw the kids,” reported the Westland Police Officer in charge of the case.

While the girls were inside the crosswalk and crossing in accordance with the lights, the woman, who otherwise had no infractions on her driving record, told police that she never slowed down and continued through the intersection because the sun was in her eyes. The children were taken directly from the scene of the accident to the hospital, where they remain in “serious but stable condition.”

Consequences of the accident are pending, but police are urging residents to take greater care in obeying traffic signals to prevent future accidents similar to this one. Fortunately those involved in this accident appear likely to make a full recovery, however, if any additional discoveries are made this situation could turn even more intense with the increasing possibility of additional legal implications.
