The Four Elements of a Tort

Understanding the Four Elements

In order to expect to receive financial compensation as a result of your lawsuit, a tort must have been committed. Torts are made up of four elements, all of which must be present. The elements are:

  • Duty. The person who injured you must have had a duty. Duty can be as simple as the duty to drive safely or the duty to maintain a staircase.
  • The breach of duty. The person who injured you failed to live up to this duty. He may have driven recklessly, or failed to maintain the staircase, making it unsafe.
  • An injury. You were injured, either physically, emotionally, or psychologically.
  • Proximate cause. The breach of the duty caused your injury.

With all four elements in place, you may well be entitled to financial compensation.
